Implementing the Endangered Species Act in water management: Roosevelt Dam, Arizona

Abstract: A study of conflicts between the Endangered Species Act (ESA) and water management was undertaken to evaluate the potential for reconciling the two, particularly in the dam and reservoir context. A case study of Roosevelt Dam in east-central Arizona was conducted to assess the effectiveness of the ESA Section 7 and Section 10 processes in implementing the Congressional policy of resolving water resource issues in concert with species conservation. Barriers to reconciling the ESA and water law and the role of courts in implementing the ESA are examined. The ESA and water law are unlikely to be made compatible; conflicts between the ESA and water management may be lessened by adapting ESA processes to fit water resource practices.
